VISION APP  

Introduction

Vision App is a cloud service that provides customers with tools for viewing, editing and sharing corporate information over the Internet through certain computers and other Internet-connected devices (“Vision App compatible devices”).

Vision App is a service provided by Skylensoft Group Srl, a limited liability company subject to Italian law. These Terms of Use govern your use of our service. In the context of these Terms of Use, “Vision App service”, “Vision service”, “Vision”, “our service” or “the service” indicate the service provided by Vision App for consultation, modification and dissemination information, including its functions and functionality, the website and user interfaces, as well as the content and software associated with our service.

  1. Subscription In order to use the service and allow users to consult the catalog, you must renew a periodic “subscription”. You can choose the duration of the period, for example from 1 up to a maximum of 36 months, knowing that the value of each subscription varies according to the duration of the subscription and that the renewal date is always calculated on the basis of the latest expiration. useful. For example, if you renew your subscription for 6 months and the previous one expires on March 31st, no matter the day of the renewal, the next expiration will be set on September 30th.

  3. Billing
    • 3.1. Billing cycle. The subscription will be charged to you via the Payment Method indicated to us, on the day corresponding to the renewal date. The corresponding invoice, if requested, will be issued at the latest by the end of the month in which the purchase falls. In some cases, the time of billing may vary.
    • 3.2. Changes to pricing and service plans. We will have the right to periodically change our service plans and the price of our service; however, any changes to the price or service plans will take effect at least 30 days after the date of the notification that will be sent to you by email.
  4. Vision Service
    • 4.1. Vision is a platform for publishing and sharing digital content but is not responsible for damages resulting from improper use of the service by the user who remains solely responsible.
    • 4.2. We regularly update the Vision service. We also regularly test various aspects of our service, including our website, user interfaces and new features. You can choose not to participate in these tests by changing the settings for “Participation in tests” on the “Your account” page.
    • 4.3. You agree to use the Vision service, including all the functions and features associated with it, in accordance with applicable laws, rules and regulations or any other limitation on the use of the service or its content. You agree not to store, download, copy, distribute, modify, display, publish, license related to, create derivative works from, offer for sale or for use (except where expressly authorized in these Terms of Use) content and information contained in or obtained from or through the Vision service. You also agree not to: circumvent, remove, alter, disable or block the content protections in the Vision service; use robots, spiders, scrapers or other automated tools to access the Vision service; decompile, reverse engineer or disassemble any software or other product or process accessible through the Vision service; enter any code or product or manipulate the content of the Vision service in any way; or use any method of data mining or data collection or extraction. You also agree not to upload, post, email or otherwise transmit or send any material intended to interrupt, destroy or limit the functionality of any software or hardware or telecommunication tool associated with the Vision service, including viruses and any other code , file or computer program. We will have the right to limit or interrupt your use of our service if you violate these Terms of Use or use our service illegally or fraudulently.
    • 4.4. WE UNDERTAKE TO KEEP VISION ACTIVE, ERROR-FREE AND SAFE, BUT YOU AGREE TO USE IT AT YOUR OWN RISK. WE CANNOT WARRANT THAT VISION WILL ALWAYS BE SAFE OR ERROR FREE OR THAT IT WILL ALWAYS WORK WITHOUT INTERRUPTION, DELAY OR IMPERFECTION. VISION IS NOT RESPONSIBLE FOR THE ACTIONS, CONTENT, INFORMATION OR DATA OF THIRD PARTIES, THEREFORE WE, OUR DIRECTORS, OFFICIALS, EMPLOYEES AND AGENTS ARE RELIEVED FROM ANY CLAIM OR DAMAGE, KNOWN OR UNKNOWN, ARISING FROM OR RELATING TO EVENTUALLY AGAINST THIRD PARTIES. WE CANNOT BE HELD LIABLE FOR LACK OF EARNINGS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT OR INCIDENTAL DAMAGES ARISING FROM OR RELATING TO THIS DECLARATION OR VISION, EVEN IF WE WERE NOTIFIED OF THE EVENT OF THE EVENT.   5. Password and login
    • 5.1. The subscriber who created the Vision account and whose Payment Method is charged (“Account Holder”) has access to their Vision administrative account and checks its settings. To maintain control of the account and prevent third party access to it (and therefore also to information on the account history), the Account Holder must not communicate to anyone the password or the details of the Payment Method associated with the ‘account (for example the last four digits of the credit or debit card, or the email address if you are using PayPal). It will be your responsibility to update the information you provide us regarding your account and to ensure it is accurate.
    • 5.2. Please treat any type of communication that requires your credit card number or other information relating to your account with the utmost caution. Providing information in response to such communications could expose you to the risk of identity theft. We invite you to access the confidential information of your account by always connecting directly to the Vision website and not through hyperlinks received by email or other electronic means of communication, even if of an official aspect. We will have the ability to close or suspend your account in order to protect you, Vision or our partners from identity theft or other fraudulent activity.
  6. Applicable law. These Terms of Use will be governed by the laws of Italy and interpreted in accordance with them. These conditions do not limit the consumer protection rights that you may benefit from under the mandatory rules of your country of residence.
  7. Third Party Applications. You may find third party applications (including, but not limited to, sites, widgets, software or other software utilities) (“Applications”) that interact with the Vision service. Your use of such Applications may be subject to the terms of use or third party license.
  8. Customer service. For more information about our service and its features or if you need assistance with your account, please send an email to support@skylensoft.com. In some cases, Customer Service will be able to better assist you by carrying out a remote access support intervention, during which we will have full access to your computer. If you do not wish to grant us such access, please do not consent to assistance via remote access; it will be our pleasure to help you through other means. In the event of a conflict between these Terms of Use and any information provided by the Customer Service Department or in other sections of our website, these Terms of Use will prevail.
  9. Survival. Should one or more provisions of these Terms of Use be deemed invalid, illegal or unenforceable, this will not affect the validity, legality and applicability of the remaining provisions, which will continue to have full validity and effectiveness.
  10. Changes to the Terms of Use Vision may periodically change these Terms of Use. We will notify you at least 30 days prior to the effective date of the new Terms of Use.
  11. Electronic communications. We will send you information relating to your account (for example payment authorizations, invoices, password changes or Payment Methods, confirmation messages, notifications) exclusively in electronic format, for example by email to the address you provided us at the time of your registration.

 

CLOUD BACKUP  

Introduction

The Cloud Backup service (hereinafter also “service”) represents an additional resource for safeguarding data in the event of natural disasters, theft or fire that damage local storage devices. It is to be considered complementary to the local data storage; Skylensoft always advises customers to do this on a regular basis. Skylensoft provides the service by connecting via the internet to a computer owned by the customer. During backup operations, said computer must be active, connected to the internet and equipped with any digital storage device (hard disk, USB key, memory card). Skylensoft has the right to use third-party devices and software for the purpose of providing the service.

Activation of the service

Skylensoft remotely connects to the customer’s computer and installs a software agent through which periodic backups will be performed and the related activity reports produced. During the configuration operation Skylensoft temporarily accesses the customer’s memory resources with the sole purpose of establishing the path that leads to the folder containing the data to be saved. At the end of the configuration, Skylensoft delivers to the customer the personal and confidential access data to the service (hereinafter also “account”).

SLA of the service

The performance of the service is closely linked to the internet bandwidth speed available to the customer, the hardware used and any data compression. The effectiveness of the service may be affected by factors related to the IT infrastructure with which the customer is equipped, such as, for example, firewalls, antivirus blocks, no or discontinuous internet line. The service is able to be active 24 hours a day, 365 days a year. Any interruptions lasting less than 4 hours per week are considered physiological and included in the tolerance range. Downtime will be measured based on the server-side error rate, due to the fact that we cannot have direct control on the user side. Any changes to the data being saved will not be saved during the backup procedure.

Account

The account provided to the customer is strictly confidential and the customer undertakes not to share it with others.
If the customer obtains an account on behalf of his company, he will bind the latter to the same conditions for providing the service. The user is solely responsible for accessing the content or sharing and using his / her account. Skylensoft is not responsible for any loss or damage resulting from any access to data through the user’s account. If the user detects unauthorized access to their account, they will be required to inform us immediately by sending an e-mail to cloudbackup@skylensoft.com.

Access to data

The customer can access their data at any time, through the confidential account. In case of suspicion that an account is being used for the storage and distribution of any illegal material, Skylensoft reserves the right to examine the contents of the saved folders. You will also be able to access your account for related support activities. Skylensoft will do everything possible to limit access to user data, however we specify that no password-protected data storage and recovery system can be entirely impenetrable. Skylensoft is not responsible for the integrity of the data saved on its devices nor of those present on the storage devices owned by the customer. Skylensoft may collect IP addresses for system administration purposes and / or to control the use of its site or to identify a user where it is necessary to enforce its policy or to protect its services, site, customers or other. The customer undertakes to provide Skylensoft with his own reference e-mail address for all communications relating to the service and to communicate any changes.

Service interruption

Skylensoft may interrupt the provision of the service in the event of payment of the fee delayed by more than thirty days or if there are grounds for suspicion of illegal or harmful content of third parties, within the saved folders.

Disclaimer and Warranties

The transmission, storage, viewing and retrieval of data and files across the World Wide Web is subject to a number of conditions that make such operations potentially unreliable. For this reason, Skylensoft is not responsible for the integrity of the customer’s data nor for any damage or loss suffered by it as a result of any inefficiencies, interruptions or intrusions from outside through theft of identification data.

Changes to the terms of this Agreement

Skylensoft reserves the right to modify the conditions of supply of the service by publishing new versions on its website. The continued use of the services by the customer after such changes will constitute implicit acceptance of the changed conditions. If the customer does not intend to accept the changes, he has the right to request the interruption of the service.

Privacy

Due to the nature of the service, we need to collect personal information from users during the registration process including first and last names, postal addresses, emails and a password. We collect and store files and data transmitted between devices using our Services. To maintain our quality of service and to assist in analyzing product performance, we may also collect data on connection information, including the timing and size of all packets sent over the Internet during a session, session date and timing. , IP, browser type, device name and / or identification number. The information collected is used to ensure the highest possible quality experience. We do not voluntarily share personal data with third parties without your express consent or unless required by applicable state and federal laws. We may use certain trusted partners to help us provide, analyze and improve the service (including but not limited to database management, web analytics and improving the functionality of the service). These third parties may have access to information solely for the purpose of performing these operations on our behalf and under obligations similar to those in this Privacy Policy. If we are involved in a merger, acquisition or sale of all or part of our assets, the information may be transferred as part of the transaction, but in this case you would be notified in time by email or through a notice posted on our site. We will keep your information for as long as your account is active. At any time, you can request the cancellation of your account. We reserve the right to keep the data even after the cancellation of the account, in case they are functional in the management of a possible legal dispute. Our services are not directed to children under the age of 18. If we become aware that we have received personal information from minors, we will immediately delete it from our records.
